If someone wrote open source code for a baby shredder machine, would the fact that the code is matter one wit? Would we be discussing the merits of the code being open source, or would we try to investigate who the hell is building a baby shredding machine?

And how is the code FOSS when the open source license governing the code is being flagrantly violated ... at the expense of the creators of the code?
