De minister voegt toe dat in Nederland telecomproviders zoals KPN of Vodafone wettelijk verplicht zijn om op basis van een gerechtelijke vordering toegang tot informatie in leesbare vorm te verstrekken. "Voor nummeronafhankelijke communicatiediensten, zoals WhatsApp of Signal, geldt deze verplichting niet. Omdat deze diensten tevens aangeven dat zij geen toegang hebben tot de communicatie van hun gebruikers, kunnen zij ook niet meewerken aan een vordering om deze informatie alsnog te verstrekken."

Volgens Van Weel heeft de situatie waarbij niemand toegang heeft tot de inhoud van communicatie behalve de gebruiker zelf en de personen waarmee deze communiceert veel voordelen. "Zo biedt het privacy. De keerzijde hiervan is uiteraard dat dit het de bestrijding van criminaliteit bemoeilijkt. 👉Communicatie over strafbare feiten komt immers meestal pas aan het licht wanneer een gebruiker daar zélf melding van maakt of wanneer een telefoon in beslag kan worden genomen én kan worden gekraakt."👈
