"...“Surveillance” is the collection or acquisition of private information, but that doesn’t include commercially available information. So if you buy something, if you buy a data set of some kind and then you analyze it, that’s not necessarily surveillance under the law...

...But if there are cameras everywhere, and they buy the data from the cameras, and then they analyze that data, that might not necessarily be surveillance..." - Dean Ball

All of the responses to the story of Proton Mail identifying customers to authorities over spurious concerns seem to emphasize the legality of the court order, but that highlights the risk of the modern era: governments acting unethically, immorally, and leveraging law power to forward this goal. And if business will always capitulate, then ultimately they are an extension of that state authority - not a servant of the customer.

So, privacy becomes a brand, not a reality.

If you are a Lloyds Banking customer you might be interested to know that one part of their strategy to become more profitable is to greatly expand their commercialisation of (anonymised) customer data.

This is to say, that while they're making money out of the interest they charge you they're going to use their data about your use of their services to make more. As with many firms, you're not so much a customer, as an (unwilling?) asset to be exploited.

EFF says an internal DHS document reported by 404 Media shows Customs and Border Protection used location data sourced from the online ad ecosystem, including real-time bidding bidstream, to track phones. The reported pilot ran in 2019-2021, and the post argues this enables warrantless location surveillance via data brokers. Suggested mitigations include disabling mobile advertising IDs, tightening app location permissions, and reducing or removing precise location and ad IDs from ad tech workflows, alongside stronger privacy laws.

Startups may be exempt from the formal requirement but must still provide a channel for data subject requests and maintain compliance practices.
