        Well, they did seize his bicycle but he soon got that back.

        What they seized was his cell phone, after indictment, since he had taken a photo of the failed lining of the Reflecting Pool before he touched it. The 2026/07/10 motion is about getting that back because it has privileged information and proof of innocence and they knew the latter because he shared that photo.

          New *motion* (not order, sorry) in USA v. the former Olympic athlete charged with destruction of the Reflecting Pool without cited evidence on a bare bones indictment which discloses nothing beyond a recitation of the statute.

          Because Hearn has exculpatory evidence, and the government has copies, and the is being repaired *under warranty* this begets the question of what exactly told the Grand Jury to get an indictment against someone who didn't lift section of the lining out of the water, like some of the misdemeanor defendants introduced in the discovery meeting.

          So today, 2026/07/27, we have that question asked as "Defendant's Motion for Disclosure of Grand Jury Minutes and Legal Instructions."

          Why?

          > the Government's sole grand-jury witness on damages testified ① the property was already damaged before Mr. Hearn allegedly touched it; ② that the same repairs would have been required regardless of Mr. Hearn's conduct; and ③ that he could not quantify any loss attributable to that conduct.

            15 minutes before the close of business on Friday, Pirro files a motion to dismiss the felony indictment without prejudice, meaning it could be reinstated at any later time withing the statute of limitations. Why? Because the Department of Interior mislead her that the damage was due to vandalism and not a bad installation job by Trump's no-bid contractors — or so she says. But ...

            ① That doesn't explain how she got the indictment itself on non-evidence

            ② That doesn't explain how she disregarded the physical evidence that Hearn documented the before state as damaged equivalent to after

            ③ Even if true, that's grounds for dismissal with prejudice and a full apology in gold leaf on parchment from Trump, Pirro, and everyone at the DOJ above Pirro.

            ④ Pirro continues to credit the eyewitnesses that Hearn reached in with two hands and violently pulled up a section, but doesn't offer documentary evidence of this from the 24/7 video cameras.
